Terms & Conditions and Liability Waiver

Please read these Terms and Conditions carefully before booking a tour, transfer, or excursion with JoyRide Escapes B.V. By booking a service through our website, via phone, email, or third-party platforms, you agree to be legally bound by these terms.

1. Booking, Confirmation, and Payments

• Reservations: A booking is only considered confirmed once JoyRide Escapes B.V. issues a formal booking confirmation via email.
• Pricing: All prices listed on our website are in USD (United States Dollars) and are subject to change without notice until a booking is fully confirmed.
• Payments: Full payment or a designated deposit is required at the time of booking to secure your date and vehicle.

2. Cancellations, Refunds, and No-Shows

Customer Cancellations:

• Cancellations made more than 48 hours prior to the scheduled tour start time will receive a full 100% refund.
• Cancellations made between 24 and 48 hours prior to the tour start time will receive a 50% refund.
• Cancellations made less than 24 hours prior to the tour start time, or “No-Shows,” are strictly non-refundable.

Cruise Ship Clause: If your cruise ship fails to dock at the Curaçao Port (Mega Pier or Mathey Wharf) due to weather or itinerary changes, a 100% full refund will be issued, provided you notify us as soon as the cancellation is announced by the cruise line.

Company Cancellations: JoyRide Escapes B.V. reserves the right to cancel or alter any itinerary due to severe weather, road conditions, vehicle mechanical issues, or force majeure. In the event of a company cancellation, you will be offered an alternative date or a 100% full refund.

3. Punctuality, Pickups, and Cruise Ship Guarantees

• Pickup Times: Guests must be at the designated pickup location (hotel lobby or cruise terminal exit) at least 10 minutes before the scheduled departure time.
• Waiting Grace Period: Drivers will wait a maximum of 15 minutes past the scheduled time before the tour is deemed a “No-Show” and forfeited without a refund.
• Cruise Return Guarantee: We guarantee to return cruise ship passengers to the port terminal at least one (1) hour before the ship’s scheduled all-board time. JoyRide Escapes B.V. is not responsible for missed ships if guests cause delays during the tour against the driver’s advice.

4. Assumption of Risk and Physical Fitness

• Nature of Excursions: Our tours involve physical activities, walking on uneven terrain, steps, cliffs, swimming, and exposure to outdoor elements.
• Guest Responsibility: By booking, you certify that you and all members of your party are in good physical health and free from any medical conditions that could make these activities hazardous.
• Voluntary Participation: You acknowledge that participating in these excursions involves inherent risks (including slips, trips, falls, and marine wildlife hazards). You voluntarily assume all risks associated with participation.

5. Limitation of Liability and Waiver

• Release of Liability: To the maximum extent permitted by Curaçao law, JoyRide Escapes B.V., its directors, employees, independent contractors, and drivers shall not be held liable for any personal injury, illness, emotional distress, property damage, theft, loss of personal items, or death occurring during or as a result of our tours.
• Third-Party Vendors: JoyRide Escapes B.V. may stop at third-party locations (such as restaurants, beach clubs, or national parks). We act strictly as a facilitator and accept no liability for the services, food safety, or actions of these independent vendors.

6. Passenger Behavior and Vehicle Rules

• Safety Instructions: All passengers must wear seatbelts while the vehicle is in motion and obey all safety instructions given by the driver.
• Right of Refusal: We reserve the right to refuse service to, or immediately terminate the tour of, any individual who displays disruptive, aggressive, unsafe, or heavily intoxicated behavior. No refunds will be given in these circumstances.
• Vehicle Damage / Cleaning Fees: Guests will be held financially responsible for any intentional or negligent damage caused to the company’s vehicles, including a minimum $150 USD deep cleaning fee for excessive staining, bodily fluids, or severe mess inside the vehicle.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by, construed, and enforced exclusively in accordance with the laws of Curaçao. Any legal disputes arising from our services shall be settled solely within the competent courts of Curaçao.
